Terms and Conditions / your rights as consumer

Important information – please read carefully.
These terms and conditions apply to all contracts entered via our website buycarparts.co.ukween Wemax Group GmbH & Co.KG, Französische Straße 12, 10117 Berlin, Germany, («we») and any natural person who is acting for purposes which are outside his business – consumer («you»).


These terms and conditions do not apply to orders for businesses, trade or profession.


We are a company with limited liability (ltd) according to German law (GmbH), registered with the administrative court (Amtsgericht) Berlin-Charlottenburg, trade-register no. HRA 46262 B.

By clicking ##send order## in the order process you agree to be bound by these terms. A copy of the agreed terms are sent to your email-address in writing after registration / placing an order. You can also download a .pdf-copy by clicking the download-button.


In addition to the given information on your rights within these terms and conditions we refer to The Consumer Protection (Distance Selling) Regulations 2000 that shall not be restricted by these terms.


1. Processing your order
You transmit your binding order and data by clicking ##send order##. By clicking the button you confirm that you have reached the age of 18 years and capable to enter a contract.


After receiving your order we automatically send an email containing the following information on your order:
- description of items, amount, price
- delivery expenses that may arise
- these terms and conditions, information on your rights and conditions to cancel the order
- the chosen method of payment and delivery


A contract will not be concluded before we send you an email confirming the order or inform you that your Goods have been dispatched. In case we refuse your order we will inform you immediately via email.


We save your data for documentation and processing your order. In case you should not receive or lose this data, we will send you a copy on demand.


2. Changing, correcting or cancelling the order

Consumers (Section 13 of the German Civil Code, BGB) have a statutory right to cancel in accordance with the following policy with reference to the online purchase of goods.

Right to cancel for consumers

You have the right to cancel this contract without giving a reason within fourteen days.

The deadline for cancellation is fourteen days from the day on which you or a third party you have designated, who is not the carrier, took possession of the last goods.
To exercise your right of cancellation, you must inform us (Wemax Group GmbH & Co.KG, Französische Straße 12, 10117 Berlin, Germany, Fax: +49 30 208 478 250, Email: info@motor-doctor.co.uk) by an explicit declaration (e.g. a letter sent by post, a fax or an email) of your decision to cancel this contract. You may use the attached sample cancellation form for this purpose, which, however, is not mandatory.

In order to meet the deadline for cancellation, it is sufficient to send the notice concerning the exercise of the right to cancel before the cancellation deadline expires.

Consequences of cancellation

If you cancel this contract, we shall return to you all the payments that we have received from you, including the costs of delivery (except the additional costs resulting, because you selected a different form of delivery than the most reasonably priced standard delivery we offered) immediately and no later than fourteen days after the day on which we received the notice of your cancellation of this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will we charge you fees for such repayment.

The following applies for goods that can normally be sent by post:

We can refuse to make the refund until we have received back the goods or until you have produced evidence that you have sent back the goods, whichever is earlier.

You must send back or hand over the goods to us without delay and, in any event, within fourteen days from the day on which you inform us about the cancellation of this contract: Wemax Group GmbH & Co.KG, Rhinstraße 132, 12681 Berlin, Germany.

The deadline is met if you dispatch the goods before expiry of the fourteen-day deadline. You shall bear the direct costs of returning the goods.

The following applies for goods that cannot normally be sent back by post (e.g. spare parts that cannot be packaged):

You shall only be liable for any loss of value of the goods if such loss of value can be attributed to handling of the goods that is not necessary to check their condition, properties and functioning.

Exceptions to the right to cancel

There are legal exceptions to the right to cancel (Section 312g of the German Civil Code, BGB), in which context we reserve the right to refer to the following towards you: There is no right to cancel for contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or specification by the consumer is decisive or that are explicitly tailored to the consumer’s personal needs.

There is no right to cancel for the delivery of goods, if these were inseparably mixed with other goods after delivery due to their properties.
Furthermore, please be informed that, pursuant to Section 357 (7) (1) of the German Civil Code (BGB), you must reimburse us for any loss of value that can be attributed to handling of the goods that was not necessary to check their condition, properties and functioning. There are court decisions to the effect that the installation of automobile parts is also “not necessary.”

3. Delivery, costs for delivery

Shipping across Great Britain:

Delivery cost for order below £ 250,00 consists of £ 8,45. We offer free shipping if the amount of the order exceeds £ 250,00 (except for delivery abroad and special types of shipping – oversized cargo and pledge).

If using payment methods like PayPal or credit card you will not charged with any additional transaction fees.

Extra charges for oversized cargo:

Following spare parts are to be considered as oversized cargo:
catalyst, manifold, muffler, racing exhaust pipes, threshold, wing, fuel tank, spoiler, trailer coupling (hitch), front cowling, engine compartment lid, engine hood, the insulation of the engine compartment and bumper.

Delivery of oversized cargo to Great Britain is not possible!

Delivery of bulky goods within Germany:
1) Shipping cost of collector, catalyst, muffler, racing exhaust pipe will be increased by £ 4,50 as oversized cargo
2) Shipping cost of threshold, fuel tank, wing, spoiler and bumper will be increased by £ 9,00 as oversized cargo
3) Shipping cost of front cowling, trailer coupling (hitch), engine compartment lid, engine hood, insulation of engine compartment across Germany will be increased by £ 13,49 as oversized cargo.

Additional fee for oversized cargo is valid for each item. Note: Shipment of oversized cargo in countries not indicated in this list is not possible.

All indicated prices include the law required VAT, which is 20%.

Delivery time:

Delivery takes 4-5 working days.

Choosing the free expertcheck option will increase the delivery time with 24 more hours.

"Safe Order":

By using the additional option "Safe Order", You can extend the opportunities of the standard Right of Cancellation. If you make a small payment in the amount of £ 3,45 / order, we are offering you a full refund and free return shippment without stating the reason within first 100 days. This option is available at the last step when ordering — "Confirm". It is valid only in case if the product is in the original packing, is not damaged and not mounted. Please note that the Right of Cancellation is not replaced by the option "Safe Order" and does not refer to it.

The Safe Order option applies only to one return per order.

Once we receive the spare part back from you, it will be thoroughly examined. If it meets the above-mentioned requirements, we will exchange the item for another one or refund your money, whichever you prefer.

Note: Safe Order terms do not apply to bulky items, old exchange car parts and tyres. Moreover, Safe Order terms will not apply to products from other orders of yours for which this option has not been selected.

4. Payment

Credit Cards:
After you chose credit card as payment method, please click on “buy”. After this you will be redirected to a secure page where you can select your credit card type. Finally, you have to enter the correct card information and to confirm the payment. Your card will be charged after your order has been completed.

PayPal:
After you place the order, you will be redirected to PayPal page. Please, log in and make payment. To pay by means of PayPal you need to have PayPal account. There are no additional tariffs.


5. Title retention clause
Title to the delivered Goods shall remain vested in us and shall not pass to you until the purchase price for the Goods has been paid in full and received by us.


6. Quality control, replacement / repair
In our shop, you will only find products that comply with high quality standards. Despite guarantees or warranties provided by the manufacturer and declared in the product’s description we guarantee the following services according to you legal rights:


If goods become faulty during the period of six years and this is not caused by its use, wrong assembly or installation, omission of maintenance or misuses, you can return them to us for a free-of-charge reparation or replacement.


If replacement or repair turns out to be impractical or to imply inappropriate costs, we can refuse the chosen method. In this case, we are entitled to refund the purchase price instead. We refund a reasonable compensation corresponding with the reduction of worth caused by the fault.


If a fault shall occur within 6 months after delivery, the faulty product will be considered as being inadequate when delivered unless we can proof that black is white.


We regret that we cannot extend this service to consumables as for instance used oil, bulbs, brake pads or batteries.


7. Limitation of Liability
7.1

No regulation in these terms excludes or limits our liability for death or personal injury caused by our negligence.


7.2.
Subject to regulation 7.1 we cannot be held liable for consequential (indirect), special or punitive loss, damage, costs or expenses, for instance loss of data caused by a product, loss of profit, loss of income; waste of time, free time.


We can also not be responsible for damage caused by wrong assembly or installation of a product that is not caused by improper instructions received from us, omissions of maintenance or misuses disregarding the given instructions.


We accept liability only for Goods which are proved faulty by reason of our negligence. Our liability is excluded in case of damage is caused by a third person, for instance by the producer of the delivered Goods and he or his insurance company can be claimed in priority.


We will not be liable for any failure in the performance of any of our obligations caused by force majeure (catastrophe, nature, strike). Our total liability will not exceed 133% of the price payable for delivered Goods caused by one or several events (except death or personal injury, see 7.1).
